EU Data Regulation

Obligations to provide information in accordance with Art. 3 para. 2 of Regulation (EU) 2023/2854

In accordance with Article 3 paragraph 2 of Regulation (EU) 2023/2854 (EU Data Regulation), we will inform you about the data generated by connected products prior to the conclusion of a potential contract. The manufacturer of the connected products is V-ZUG AG, Industriestrasse 66, 6300 Zug, Switzerland (V-ZUG).

1. Type, format and volume of the data

The product collects the following data, which is made available to the user for download during use:

- Product ID - Firmware versions - Information about any upgrades carried out (V-Upgrade data)

Format: the data is made available in a structured, machine-readable format, primarily using JSON (JavaScript Object Notation) files. This widely used format simplifies subsequent processing.

Estimated volume: the amount of data is low, as no actual usage or operational data is collected or stored. We estimate the data volume per connected product to be a few kilobytes.

2. Continuous data generation in real time

The connected product can continuously generate data during operation (e.g. energy consumption) in order to control internal processes (e.g. to send push notifications). Real-time access to this data is not provided, however. This internal process-related usage data is not stored persistently and is therefore not considered readily available data.

3. Data storage location and duration

Storage location: the available data is stored both on a remote server (cloud) and locally on the product itself.

Storage duration: there is no active limit on the duration of data storage.

4. Data access, retrieval and erasure

Access and retrieval: you can access your product data easily, securely and free of charge at any time via our mobile app (V-ZUG Home app: [URL or QR for app stores (Apple and Google Play)]). Upon successful authentication with your user account, you will have the option to download the raw data in the specified format.

Erasure: the app allows you to erase all your stored product data at any time. The erasure will be carried out within 14 days of your request.

Technical means: to access the data, you will need a mobile device (smartphone) and your personal access credentials for our mobile app.

Terms of use & quality of service: access to the data is subject to the terms of use of the V-ZUG Home app and its integral components. V-ZUG makes the mobile app available for use in accordance with the latest technological standards. However, there may be temporary restrictions or interruptions, such as those attributable to maintenance work, improvements or technical faults that are beyond the control of V-ZUG. In particular, V-ZUG is not responsible for the functionality or availability of the user’s mobile phone connection or other communication networks, any resulting usage restrictions or delays, or the availability of the application for download in an app store.

Obligations to provide information in accordance with Art. 3 para. 3 of Regulation (EU) 2023/2854

In accordance with Article 3 paragraph 3 of Regulation (EU) 2023/2854 (“EU Data Act”), we inform users of networked V-ZUG products and the V-ZUG Home App (“V-ZUG Home”) about the data generated by their operation.

1. Device product data

The products record various technical and operational data during operation, in standby mode and, in some cases, even when switched off. The app has contributions from:

- Product ID - Firmware versions - Information about any upgrades carried out (V-Upgrade data)

The data is collected and made available in a structured, machine-readable format, primarily using JSON (JavaScript Object Notation) files.

The amount of data is low, as no actual usage or operational data is collected or stored. We estimate the data volume per connected product to be a few kilobytes.

2. Related service data (V-ZUG Home)

V-ZUG Home generates additional data in connection with the control and monitoring of the products. This includes:

- Control commands (start, stop, program selection, temperature setting, timer); - Status and feedback data (confirmation of commands, feedback from devices); - Usage and interaction logs (e.g. frequency and time of use of V-ZUG Home); - Software/firmware update information.

Depending on how often V-ZUG Home is used, the scope of the data processed amounts to several data sets per interaction. Processing takes place in real time every time V-ZUG Home is used, whereby this data is not stored by the data holder, but directly discarded.

3. Usage by the data holder and third parties

V-ZUG may use the data collected by products and V-ZUG Home itself for the following purposes:

- Ensuring proper operation; - Fault diagnosis and maintenance planning; - Improving products and services; - Statistical and anonymised evaluations of product development.

Sharing with third parties takes place only with the express consent of the user and only for the agreed purposes (e.g. service partners for maintenance).

4. Identity of the data holder

The data holder is V-ZUG AG, Industriestrasse 66, 6300 Zug, Switzerland.

6. Sharing with third parties

Users can access their data easily, securely and free of charge at any time via the V-ZUG Home Mobile App and request that their data be shared with third parties (e.g. other service providers) at [email protected]. Data sharing can be terminated at any time by changing the settings.

7. Right to lodge a complaint

Users have the right to lodge a complaint with the competent supervisory authority about violations of the provisions in accordance with Article 37 of the EU Data Act.

8. Trade secrets

The data collected by the products and V-ZUG Home may contain trade secrets, e.g. in connection with internal algorithms or specific operating parameters. V-ZUG is the owner of these trade secrets unless a third party is expressly named as the owner.

9. Term of contract and termination

The term of contract between the user and V-ZUG is governed by the terms of use. Users have the right to terminate the contract prematurely in accordance with the provisions contained therein.
